Residence Permit for Real Estate Investor in Brazil

Individuals who intend to carry out real estate investment in Brazil, with their own resources of external origin, with the potential to generate jobs or income in the country, may apply for a residence permit. Obtaining the residence permit for real estate investment is subject to the acquisition of real estate, located in an urban area, in an amount equal to or greater than R$1,000,000.00 (one million reais), which may be:

(a) acquisition of already built property; or

(b) acquisition of real estate under construction.

This value may be reduced if the property is in the north or northeast region of the country.

Applicable Permit

Brazil has a specific residence permit for real estate investors.

Applicable legislation

Normative resolution nº 46, from the Brazilian Nacional Immigration Council, of August 8th, 2022, disciplines the granting of this residence authorization for migrants that invest in real estate in Brazil.

Main Requirement

The main requirement is the acquisition, with foreign investment, of urban property in Brazil, whether built or under construction, in the amount of at least:

  • R$700,000.00 (seven hundred thousand reais) for properties located in the North Region or Northeast Region of the country; or
  • R$1,000,000.00 (one million reais) for properties located in other regions.

Peculiarities

The real estate investment may occur through the acquisition of more than one property, provided that the sum of all properties corresponds to the amount established in the applicable legislation as described above: (i) R$700,000.00 (seven hundred thousand reais) for properties located in the North Region or Northeast Region of the country; or (ii) R$1,000,000.00 (one million reais) for properties located in other regions.

When the value of the property exceeds the minimum amount required to apply for a residence permit, the value that exceeds the minimum amount may be paid in installments.

The real estate investor must remain in the national territory for at least 14 (fourteen) days during the period granted in the residence permit, counted from the date of registration with the Federal Police.

Issuance

It takes around 30 days for the residence permit to be approved, counting from the date the process is filled.

Validity

This residency authorization for real estate investors will be valid for 4 (four) years, provided that this validity period may be renewed.
