Visiting visa

Visiting visas may be granted to visitors who come to the country for a short stay, with no intention of establishing residence, for the purpose of:

  • Tourism — comprises tourism, informational, cultural, educational or recreational activities, family visits, participation in conferences, seminars, congresses or meetings, voluntary service or research, teaching or academic extension, provided that the visa beneficiary does not perform a remunerated activity in the country and the activity has no longer term than allowed, as indicated below.
  • Business — comprises participation in meetings, fairs and business events, journalistic coverage or filming and reporting, prospecting for business opportunities, signing contracts, performing audits or consultancy, and acting as a crew member of an aircraft or vessel, provided the visa beneficiary does not perform any paid activity in the country and the activity does not have a longer term than allowed, as indicated below.

  • Artistic and sporting activities or exceptional situations of national interest

 

Expiry date

(period when the visa can be used to enter the country)

General rule – one year of validity. Multiple entries are allowed in Brazil during the visa validity. The Ministry of Foreign Affairs may reduce the term at its sole discretion.

 

Period of stay

(period when the visa holder can stay in the country; starts to be counted on the day of first entry)

Up to 90 days, renewable by the Federal Police for up to 90 more days, provided that the maximum stay in the country does not exceed 180 days each migratory year. The count of the period of stay starts at the first entry and is suspended whenever the visitor leaves the country.

 

Extension of stay

Up to 90 days, provided that the maximum stay in the country does not exceed 180 days each migratory year. The extension is granted by the Federal Police.

 

Visa Waiver

The Ministry of Foreign Affairs may issue rules on the simplification of procedures for granting or visa waivers. Visa Transformation

There is a legal provision for the transformation of the visiting visa into residence permit, diplomatic visa, official visa or courtesy visa, provided that the visitor meets the legal requirements.

Residence Permits

Residence for nationals and persons who have the nationality originating in one of the  countries that are endorsed by the Mercosur Residential Agreement that comes to reside in Brazil.

 

Key requirements

Being national of one of the states signatories to the Mercosur Residency Agreement (Argentina, Bolivia, Chile, Colombia, Ecuador, Paraguay, Peru and Uruguay). And attend the Federal Police with:

  1. Application for a residence permit completed;
  2. Mandatory documents;
  3. Proof of payment of fees when there is such obligation.

  1. Valid passport, or identity card, or certificate of nationality
  2. Birth or Marriage Certificate.
  3. CPF
  4. Address of residence in Brazil.

 

Peculiarities

  1. It is possible to include the family of the migrant who will have the same rights as the holder, even if he is of a nationality different from the applicant, even if a national of a country not a signatory to the treaty, provided that the appropriate guidelines provided for are observed.
  2. Right to engage in any activity, on their own account or on behest of third parties, under the same conditions as nationals.

 

Validity and Renewal

The initial term is two years, as the residence is classified as temporary.

After 2 years, temporary residence may, in compliance with the requirements laid down in that decree, be transformed into residence for an indefinite period.

Residence permit applicable to the migrant who comes to Brazil to perform the role of administrator, manager, director or executive with management powers in civil or commercial society, economic group or conglomerate.

 

Primary requirement

Foreign investment carried out and integrated in the capital stock of the Brazilian company, duly registered in a Commercial Registry or in a Registry Office.

 

Documents

1. Corporate act of the indication of the migrant for the position, duly registered in a Commercial Registry or in a Registry Office;

2. Corporate act proving subscription and integralization of the foreign investment in the capital stock of the Brazilian company, duly registered in a Commercial Registry or in a Registry Office:

  • (i) R$ 600,000.00 (six hundred thousand reais), upon presentation of the “Quadro Societário Atual” (Current Corporate Structure) screen of the Central Bank’s website and the exchange contract issued by the Bank that received the investment; or
  • (ii) R$ 150,000.00 (one hundred fifty thousand reais), upon presentation of the “Quadro Societário Atual” (Current Corporate Structure) screen of the Central Bank’s website and the exchange contract issued by the Bank that received the investment and a generation plan of at least ten new jobs within two years.

3. Corporate document of the Brazilian legal company and act of election or appointment of its legal representative, duly registered in the competent body, as well as the Taxpayer Registration Number – CNPJ;

4. Migrant’s valid travel document.

 

Peculiarities

1. The migrant is linked to the company and to the exercise of the function designated in the corporate act, but can simultaneously assume other management positions in other companies of the same economic group, provided that prior authorization has been granted by the Ministry of Justice.

2. It is necessary to present complementary documentation of the regulatory bodies in case of occupancy of a position in an insurance company, capitalization company, private pension fund entity, financial institution and other institutions authorized to operate by the Central Bank of Brazil, as well as air transport and ancillary services company.

3. Any changes in the conditions initially reported to the Ministry of Justice depend on the communication or consent of the aforementioned body, as the case may be.

4. The migrant is qualified as a tax resident.

 

Validity and Renewal

Indefinite validity or according to the deadline established in the corporate documents of the Brazilian company. Renewal allowed, subject to the same conditions.

Granted to retired migrants or death-pension recipients.

 

Main requirements / Documents

  • Proof of retirement, or receipt of death pension and monthly transfer capacity of amount equal to or higher than US$ 2,000.00;
  • Proof of other regular sources in order to complement the value required above;

 

Validity and Renewal

  • The initial period of residence of the migrant with the authorization will be up to 02 years, and the renewal is possible by proving the means of stay in the country.

Residence permit applicable to migrants who will stay in the country for more than 90 days as an artist or sportsman/sportswoman, without employment relationship.

It covers coaches and other professionals who participate as assistants in the artist or sportsman/sportswoman’s activities.

 

Main Requirement

Participation in exhibitions, shows, artistic performances, artists’ meetings, sports competitions and other similar activities.

 

Documents

1. Contract to provide services for a fixed term, without employment relationship, with the following information: qualification of the contracting parties; validity; object of the contract and definition of the respective obligations; program title, show or production, even if provisional; indication of the character or work, when applicable; venue, date and time of events, including optional ones; total amount of remuneration and form of payment; the value of each presentation and the amounts paid in any capacity; travel and travel arrangements in accordance with current legislation; adjustment of possible inclusion of the contractor’s name in the presentation credit, posters, printed matter and programs; name and address of the contractor’s legal guardian in each of the states where the contractor will be present, for the purpose of issuing notification, as appropriate, at the discretion of the regional authorities.

2. List of the group members, when applicable.

3. Corporate document of the Brazilian legal company and the act of election or appointment of its legal representative, duly registered with the competent body, as well as National Register of Legal Entities – CNPJ.

4. Migrant’s valid travel document.

 

Peculiarities

1. The regularization of the contract in the association representing the professional category and other entities (Brazilian Musicians Association, for example), when applicable, and the tax and labor obligations are the contractor’s sole responsibility.

2. Paid activity is allowed, provided it is artistic or sporting.

3. This residence permit does not apply to the artist or sportsman/sportswoman who comes to the country under an individual employment contract.

4. The migrant is qualified as a tax resident after 183 days, consecutive or not, physically present in Brazil, counted within 12 months.

 

Validity and Renewal

Validity up to one year counted as of 90 days. Renewal allowed.

Visa renewal for individuals over fourteen and under eighteen is subject to proof of enrollment and school achievement.

Residence permit applicable to a migrant who comes to provide technical services in Brazil, without employment relationship with the national company, by contract, cooperation agreement or agreement signed between a Brazilian company and a foreigner one.

 

Primary requirements

1. The application may be requested by (i) the company receiving the technical assistance service; (ii) a member of the same economic group as the migrant’s foreign employer; (iii) intermediate company between the migrant’s foreign employer and the Brazilian company, due to contract with express exclusivity clause in Brazilian territory.

2. The concept of technical assistance excludes purely administrative, financial and managerial functions.

3. The place of service must be informed to the Ministry of Justice, as well as any changes.

 

Documents

1. Document issued and signed by the Brazilian Internal Revenue Service, in the case of equipment purchase and sale related to the technical assistance.

2. A contract, cooperation agreement or agreement signed, in case of technical assistance to the equipment.

3. Declaration by the Brazilian company, in the case of technical cooperation between companies of the same group, with identification of the parties and information of the existing associative bond.

These documents must contain, among other information: (i) the contracting parties, (ii) the object of the service or purchase of the equipment, (iii) the term and / or warranty and (iv) the place and date of the signature or purchase of the equipment.

4. Corporate document of the Brazilian legal company and act of election or appointment of its legal representative, duly registered in the competent body, as well as the Taxpayer Registration Number – CNPJ;

5. Migrant’s valid travel document.

 

Peculiarities

1. In cases of urgency, the residence permit may be granted for a period of 180 days, within five working days, by means of an invitation letter from the interested company.

2. In a proven emergency, in a simplified procedure, a residence permit may be issued within two working days.

3. Identified provision of services in accordance with Brazilian labor legislation may be denied or decreed the loss or cancellation of residence permit.

4. The responsibility for the migrant lies with the company to which him/her provides technical assistance.

5. The migrant is qualified as a tax resident after 183 days, consecutive or not, physically present in Brazil, counted within 12 months.

 

Validity

Validity of up to one year, except for contracts that, due to their nature and object, contain warranty clause, in which case their validity will be observed.

Residence permit applicable to a migrant who comes to Brazil supported by an employment contract with a Brazilian company.

 

Primary requirements

1. Compatibility of the activities that the migrant will perform in the country with his/her qualification and professional experience.

2. Compatibility with the limit of 1/3 of foreign employees in relation to Brazilian employees, regarding total employees and payroll.

 

Documents

1. Certificate of completion of master, doctorate or higher degree; or

2. Completion of a postgraduate course with at least 360 hours and professional experience of at least one year in the area of specialization; or

3. completion of higher degree and work experience of at least two years after graduation; or

4. completion of technical course and professional experience of at least three years; or,

5. for an occupation that does not require technical or higher level, proof of minimum education of 12 years and professional experience of at least four years; or,

6. For an artistic or cultural activity that does not require schooling, proof of professional experience of at least three years.

7. Employment contract between the Brazilian legal company and the migrant. 

8. Corporate document of the Brazilian legal company and act of election or appointment of its legal representative, duly registered in the competent body, as well as the Taxpayer Registration Number – CNPJ;

9. Immigrant’s valid travel document.

 

Peculiarities

1. The employment relationship is governed by Brazilian labor law.

2. It is forbidden for the migrant to perform management activities or to be included in the incorporation articles of the Brazilian company that has the power to represent it as an administrator.

3. Exceptionally, depending on the activities that will be performed in the country, the Ministry of Justice may authorize the request upon proof of professional experience of at least five years in activity related to that which will perform in Brazil, without the schooling proof.

4. The migrant is qualified as a tax resident.

Up to two years of validity. It may be renewed indefinitely.

Residence permit for internship or professional exchange.

 

Main Requirements

1. International social and labor learning experience in the workplace, to improve academic education and the exchange of cultural and professional knowledge and experience.

 

Documents

1. Proof of enrollment in undergraduate or postgraduate course or completed less than a year ago.

2. Full or part-time temporary employment contract or internship.

3. Deed of undertaking between the migrant and the employer, with the participation of a Brazilian exchange entity, where applicable, stating the terms of the exchange program.

 

Peculiarities

1.

1. The migrant may or may not have an employment relationship in Brazil.

2. A migrant wishing to work in the country during the school holidays may obtain prior residence permit to issue a temporary visa. This authorization is valid for up to 90 days, non-extendable, and is granted by the Ministry of Labor upon presentation of the following documents:

  • Proof of enrollment in undergraduate or postgraduate course abroad with at least 360 hours.
  • Part-time or full-time employment contract between the applicant company and the immigrant.

 

Validity and Renewal

One-year validation. Renewal forbidden.

Modality of residence permit applicable to a migrant who comes to the country to attend a regular course or to do an internship or study or research exchange.

 

Main Requirements:

1. proof of the applicant’s financial standing or the person responsible for its maintenance in Brazil during the entire period of stay in the country or proof of scholarship, if applicable;

2. proof of enrollment in a Brazilian educational institution, in case of residence permit for study purposes in Brazil;

3. proof of enrollment in an undergraduate or postgraduate course in a foreign educational institution, in the case of residence permit for internship or exchange of study or research purposes;

4. Term of commitment between the intern, the granting party of the internship and the educational institution, and the document must certify the compatibility between the course and the internship activities, when the residence permit is required for this purpose.

 

Peculiarities

1. It is allowed the exercise of paid activity, as long as linked to the educational institution and compatible with the course load.

2. The renewal of the residence period is subject to proof of the continuity of the study, by means of the school enrollment and achievement document and the means of subsistence in Brazil.

3. The educational institution has a legal obligation to notify the Federal Police of any immigrant’s dismissal.

The initial term of the residency is up to one year, renewal allowed linked to the term of course completion.

Residence permit applicable to an individual migrant who intends to invest in a legal entity in Brazil with own resources of external origin.

 

Primary requirements

  • Foreign investment made and paid in the capital stock of the Brazilian company, duly registered in a Commercial Registry or in a Registry Office.

 

Documents

1. Corporate act duly registered with the Board of Trade or Civil Registry Office proving the subscription and payment of foreign investment in the capital stock of the Brazilian company of at least:

(i) R $ 500,000.00 (five hundred thousand reais);

(ii) R $ 150,000.00 (one hundred and fifty thousand reais) for the purpose of investing in an innovation activity, basic or applied research, scientific or technological, in addition to the following conditions:

  • The venture receiving this investment must meet at least one of the following conditions: (i) the investment shall be intended for government institution innovation; (ii) be located in a technology park; (iii) being incubated or graduated enterprise; (iv) must have been a finalist in a government program supporting startups; (v) have benefited from startup accelerator in Brazil; or
  • Constitute the Company’s main activity and consider the product, process or service (i) original as to the degree of novelty (ii) comprehensive as to the degree of penetration and (iii) relevant as to the degree of impact and potential to generate value.

2. Investment or Business Plan with execution period of 3 (three) years includes the following topics: (i) business definition; (ii) venture purpose and (iii) job or income generation.

3. Statement of foreign investment by presenting the screen “Quadro Societário Atual” (Current Corporate Structure) – Declaratory Registration of Foreign Direct Investment in Brazil – of the Central Bank website, proving the payment of the investment in the receiving company;

4. Exchange contract issued by the receiving bank.

5. Corporate document of the Brazilian legal company and act of election or appointment of its legal representative, duly registered in the competent body, as well as the Taxpayer Registration Number – CNPJ;

6. Immigrant’s valid travel document.

 

Peculiarities

1. The Ministry of Justice may perform investigations to verify the compatibility of the plan presented with the company’s activities and request additional documentation.

3. For purposes of residence continuity, exceptionally, the economic context, the purpose of the activity and the potential for job or income generation in the country may be observed.

3. The migrant is qualified as a tax resident.

 

Validity and Renewal

Indefinite validity or according to the deadline established in the corporate documents of the Brazilian company. Term renewal conditional on proof of the investment or business plan requirements.

Residence Permit applicable to migrants who come to Brazil based by external investment in property located in Brazilian territory.

Main requirement

Acquisition of urban property in Brazil, whether built or under construction, in the amount of at least R$ 1 million, or for properties located in the North / Northeast regions of the country, in the minimum amount of R$ 700 thousand.

Documents

For built properties: 

  • Valid travel document of the migrant; 
  • General Property Registry, attesting to the investor’s ownership of the property, free of encumbrances or charges; 
  • Declaration of a credit institution authorized or registered in the national territory with the Central Bank of Brazil, attesting to the international transfer of capital.
For properties under construction:

  • Valid travel document of the migrant;
  • Promise Agreement for the Purchase and Sale of the property, duly registered; 
  • Declaration of a credit institution authorized or registered in the national territory with the Central Bank of Brazil, attesting to the international transfer of capital, or for payment, as a sign in the Promise of Purchase and Sale Agreement:
                      – Building permit;
                      – Merger Memorial. 

Peculiarities

To achieve the minimum value of the investment in question, the acquisition of more than one property.

It is possible to pay in installments the excess value of property that exceeds the minimum amount required to apply for a residence permit.

The migrant will be qualified as a tax resident in Brazil.

Validity and Renewal

The temporary residence permit granted in this modality has a period of 04 years. During the period of temporary residence, the real estate investor must reside in national territory for a minimum period of 14 days, consecutive or interpolated, every 2 years.
Once the initial temporary period has expired, the migrant has the possibility of renewing his authorization for an indefinite period.

Residence permit for researching, teaching or academic extension to scientist, researcher or teacher wishing to stay in Brazil for more than 90 days, without employment relationship with the Brazilian institution.

 

Primary requirements

1. Scholarship beneficiary – presentation of responsible institution certificate.

2. Scientist or researcher housed by international agreement – presentation of invitation on the migrant’s behalf in which reference is made to the international agreement recognized by the Ministry of Foreign Affairs.

3. Migrant maintained by a foreign institution – presentation of the interinstitutional agreement or similar instrument entered into between the Brazilian higher education institution and the foreign higher education or research institution;

 

Peculiarities

1. The scientist or researcher may receive payment from the government, Brazilian employer or private entity, as per night, allowance, fee, pro-labore or travel expenses; may compete for prizes, including cash, in competitions or contest in the area of science, technology and innovation.

2. The migrant is qualified as a tax resident after 183 days, consecutive or not, physically present in Brazil, counted within 12 months.

Residence permit applicable to migrants who come to Brazil, and who is a family member of a Brazilian or a migrant with a residence permit in Brazil.

 

Key requirements

I – spouse or partner;

II – child of a Brazilian or migrant who is granted a residence permit;

III – stepson of a Brazilian or a migrant who is granted a residence permit, provided that he/she is under eighteen years of age, or up to the age of twenty-four years, if proven a student, or of any age, if economic dependence is proven;

IV – who has a Brazilian child;

V – who has a migrant child receiving a residence permit;

VI – ascendant up to the second degree of Brazilian or migrant beneficiary of residence permit;

VII – descendant to the second degree of Brazilian or migrant beneficiary of residence permit;

VIII – brother of a Brazilian or migrant who is granted a residence permit, provided that he or she is under eighteen years of age, or up to twenty-four years of age, if proven to be a student, or of any age, if economic dependence is proven; ou

IX – who has Brazilian under his tutelage or guard.

 

Documents

  1. Valid travel document or official identity document;
  2. Birth certificate or marriage or consular certificate;
  3. Birth certificate or marriage to prove the relationship between the applicant and the Brazilian or migrant beneficiary of a residence permit, or a skilled document proving the bond;
  4. Identity document of the Brazilian or migrant beneficiary of a residence permit, with which the applicant wishes to meet;
  5. Declaration, under the penalties of the law, that the family member resides in Brazil;
  6. Documents proving economic dependence, where appropriate;

 

Peculiarities

  1. The proof of the stable union may be given by the presentation of:
    • Stable union certificate issued by the competent authority of the country of origin; Or
    • Proof of stable union issued by competent judgment in Brazil or corresponding authority abroad.
  1. The application for a temporary visa and authorization to stay for family reunion purposes may occur concomitantly with the application for the temporary visa of the calling family member.
  2. Where the application is on the basis of a meeting with a migrant who has been granted residence for a specified period of time, the expiry date of the residence permit of the so-called family member shall coincide with the expiry date of the residence permit of the receiving family member.
  3. The beneficiary of the residence permit for family reunion purposes may carry out any activity in the country, including remunerated, on an equal footing with the Brazilian national, in accordance with the legislation in force.

 

Validity and Renewal

The temporary family reunion visa will have a maximum validity period of one year.

For cases of family reunion for brazilian family members, the initial residence period will be 9 years.

And for family reunion with migrant benefited from residence, the expiration date of the authorization will coincide with the date of the striking family member.

Residence permit applicable to a migrant who comes to work in Brazil without employment relationship, with a national company, to provide technology transfer services by contract, cooperation agreement or agreement signed between a Brazilian company and another abroad.

 

Main Requirements

1. The application may be requested by (i) the company receiving the technology transfer service; (ii) a company of the same economic group as the foreign company employing the migrant; or (iii) an intermediate company between the foreign migrant’s employer and the domestic company due to contract with express exclusivity clause in Brazilian territory.

2. The location of the service should be informed to the Ministry of Justice, as well as any changes.

 

Documents

1. Contract, cooperation agreement or agreement signed that includes, among other information, the purpose of technology transfer to Brazilian professionals, the value, validity and execution terms.

2. Declaration of the Brazilian company with parties’ identification and information of the existing associative bond, in case of technical cooperation between companies of the same group.

3. Training plan, containing (i) migrant’s professional qualification, (ii) scope of training, (iii) manner of execution, (iv) number of Brazilians to receive training, (v) place of execution, (vi) recipient companies, if applicable, (vii) duration and (viii) expected results.

4. Corporate document of the Brazilian legal company and the act of election or appointment of its legal representative, duly registered with the competent body, as well as National Register of Legal Entities – CNPJ;

5. Migrant’s valid travel document.

 

Peculiarities

1. If services are identified in accordance with Brazilian labor law, the residence permit may be denied or canceled.

2. The migrant is qualified as a tax resident after 183 days, consecutive or not, physically present in Brazil, counted within 12 months.

 

Validity and Renewal

Validity up to one year. Renovation allowed, subject to a one-year period.

Residence permit applicable to a migrant who comes to Brazil to receive professional training at the Brazilian branch, subsidiary or head office of the same economic group as the foreign company.

 

Primary requirements

1. Professional training is the activity that aims to develop skills and knowledge through practical work.

 

Documents

1. Proof of the relationship between the Brazilian subsidiary, branch or parent company and the foreign company.

2. Proof of employment relationship between the migrant and the foreign company.

3. Training plan that includes (i) justification of the migrant’s training in Brazil, (ii) scope (iii) execution method (iv) place of execution (v) granting company (vi) duration (vii) expected results.

4. Corporate document of the Brazilian legal company and act of election or appointment of its legal representative, duly registered in the competent body, as well as the Taxpayer Registration Number – CNPJ;

5. Immigrant’s valid travel document.

 

Peculiarities

1. The migrant’s employment relationship remains with the company abroad.

2. The migrant is qualified as a tax resident after 183 days, consecutive or not, physically present in Brazil, counted within 12 months.
